Every year lakhs of people in Maharashtra move into a new home, a new shop, or a new office. And almost every single one of them signs a rent agreement without fully understanding what they are signing.

Some landlords give a one page handwritten paper and call it done. Some tenants move in on a verbal promise. And then six months later there is a fight about the deposit, the notice period, who pays for repairs, or whether the tenant can be asked to leave without warning.

  • The monthly rent amount in both numbers and words should be written clearly along with the due date for payment every month.
  • The security deposit amount must be mentioned along with the conditions under which it will be returned or deducted. Many disputes happen because this section is vague. Make sure it clearly states how many months rent is taken as deposit and what deductions are allowed.
  • Maintenance and minor repairs: The agreement must mention who is responsible for maintenance and minor repairs. Typically the tenant handles day to day maintenance and the landlord handles major structural repairs - but this should be written explicitly.
